At OverstockBay.com (“OverstockBay”, “we”, “our”, or “us”), we aim to ensure a smooth and secure buying experience for lot stock, surplus, and overstock transactions. This policy outlines the terms under which refunds and returns will be handled when payments are processed through our platform.


1. Our Role

  • OverstockBay acts as a transaction facilitator between buyers and sellers.

  • We collect payments from buyers and release them to sellers only after confirmation of delivery or as per the agreed transaction terms.

  • We hold payments until order completion.


2. Eligibility for Refunds

A refund may be initiated if:

  • The seller fails to ship or deliver the product within the agreed time.

  • The delivered items are significantly different from the description.

  • The order is cancelled before it is marked as “Shipped”.

  • The seller agrees to a return/refund request.


3. Return Process

  • Buyers must submit a return request within 3 days of delivery with proof (images, videos, or other documentation).

  • The seller must approve the return, unless the claim falls under non-delivery or gross misrepresentation, in which case OverstockBay may intervene.

  • Returned items must be sent back to the seller in their original condition, unless otherwise agreed.

  • Return shipping costs are the buyer’s responsibility unless the seller agrees to cover them.


4. Refund Process

  • Once the return is approved and the seller confirms receipt of the item, we will initiate the refund to the buyer’s original payment method.

  • Refunds may take 5–7 business days to reflect, depending on the payment provider.

  • If the seller disputes the return, OverstockBay will review the case and make a final decision based on evidence provided by both parties.


5. Non-Refundable Cases

Refunds will not be provided if:

  • The buyer changes their mind after receiving the product without a valid reason.

  • The buyer fails to raise a return/refund request within the allowed time.

  • The issue arises from misuse, improper storage, or damage caused after delivery.


6. Dispute Resolution

  • Both buyers and sellers agree to cooperate in providing evidence for disputes.

  • OverstockBay’s decision in a disputed case will be final and binding.
